Who are the perpetrators and how can they be found?

In isolated cases, it may involve discreet disposal of evidence in a criminal case, though such scenarios are more common in U.S. crime series than in local forests. If waste is repeatedly dumped on the same private or business properties, it could be a deliberate act to harm individuals or companies, for example in cases of stalking, bullying, defamation, or simple revenge. Consequences of illegal waste disposal: from fines to imprisonment of up to five years

The penalties for unauthorized waste disposal vary greatly depending on the severity of the offense. If it is merely an administrative offense, the respective waste regulations of the federal states or regions apply, which in turn specify different fines (for the Rhein-Neckar district, the current regulation applies). However, if the provisions of § 326 of the German Criminal Code (StGB) "Unauthorized Handling of Waste" are met, it constitutes a genuine criminal offense: anyone who disposes of waste dangerous to humans, animals, or the environment (e.g., disease-promoting, toxic, or explosive) improperly can be punished with imprisonment of up to five years or a fine, and even attempted offenses are punishable. Those who do not deliver radioactive waste, but instead store or use it themselves, may face up to three years of imprisonment.

 

In addition to § 326 StGB, other criminal offenses such as dangerous bodily harm (§ 224), stalking (§ 238), property damage (§ 303), or trespassing (§ 123) may also apply.

As mentioned, there is both deliberate and negligent disposal of waste in unauthorized locations, often in poorly visible and sparsely visited or temporarily abandoned areas such as forests, fields, or industrial areas, which are used to avoid expensive recycling and waste fees at recycling centers. Additionally, misuse of neighbors’ trash bins occurs in virtually every municipality. Although this may seem trivial, this form of abuse is not only extremely annoying but at least constitutes an administrative offense. Furthermore, the person who deposits waste in your bin can be legally required under § 1004 BGB “Removal and Injunction Claim” to remove the waste, refrain from future repetitions, and compensate for any damages caused.
